These terms apply to purchases from Tosca Bros Packaging, operated by TOSKAS TRADING PTY LTD (ABN 74 697 367 212).
Product descriptions, pack quantities and availability are provided in good faith. Images are illustrative and screen colours may vary. Prices displayed on the storefront exclude GST unless stated otherwise. GST and delivery charges are shown at checkout before payment.
We may correct genuine pricing, stock or description errors before accepting an order. If an error affects an order already placed, we will contact the customer and offer an appropriate correction or refund.
An order is an offer to purchase. We may decline or cancel an order where payment is not authorised, stock is unavailable, delivery is outside our service area, fraud is suspected or a material pricing or product error has occurred. If payment has been captured for an order we cannot accept, we will refund it.
Customers must provide accurate contact, billing and delivery information and must be authorised to use the selected payment method.
Quantity-based and promotional prices apply only when the stated conditions are met in the cart and checkout. If quantity drops below a threshold, the applicable ordinary price returns automatically. Subscription discounts and one-off full-carton discounts do not combine unless checkout expressly says otherwise.
Partner Pricing renews monthly until paused or cancelled. The recurring amount, products and billing frequency are disclosed at checkout. Customers are responsible for managing changes before the next billing date. Subscription orders remain subject to availability, delivery terms and the Partner Pricing subscription cancellation policy.
Custom can quotes are estimates until confirmed in writing. Production begins only after commercial terms and artwork are approved. The customer confirms that supplied artwork can lawfully be reproduced and does not infringe another party's rights. Colours, print placement and production tolerances may vary within reasonable manufacturing limits disclosed or accepted during approval.
Nothing in these terms excludes, restricts or modifies a consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law. To the extent permitted by law, we are not liable for indirect or consequential loss that was not reasonably foreseeable from our supply of the goods.
These terms are governed by the laws of New South Wales, Australia. Courts with jurisdiction in New South Wales may hear disputes, subject to any rights that apply under consumer law.
